Welcome to Global Transland Logistics (“we”, “us”, “our”, “GT Logistics”). These Terms & Conditions (“T&Cs”) govern your use of our delivery services (“Services”), including any pickup, transport, customs handling, warehousing and final delivery of goods (“Shipments”). By engaging our Services, you (the “Customer”) accept and agree to be bound by these T&Cs. If you do not agree with any part of these terms, please do not proceed to use our Services.


1. Definitions

1.1 Customer means the person or entity contracting with GT Logistics for the provision of the Services.

1.2 Shipment means the goods or items accepted by GT Logistics for transport, handling, storage or delivery under the agreement with the Customer.

1.3 Delivery means the completion of the Service when the Shipment is handed over to the specified consignee at the agreed place.

1.4 Insurance Payment means a payment made by the Customer for insurance cover arranged via GT Logistics for the Shipment.

1.5 Refundable Insurance Payment means an insurance payment which becomes refundable upon successful Delivery, as specified in Section 8.

1.6 Agreement means the contract between GT Logistics and the Customer, incorporating these T&Cs, any quotation or service order, and any applicable service schedule.


2. Scope of Application

2.1 These T&Cs apply to all Services provided by GT Logistics, unless otherwise agreed in writing.

2.2 Any general conditions of purchase, sale or other terms provided by the Customer are expressly excluded unless accepted in writing by GT Logistics.

2.3 The Agreement subsists from the time the Customer accepts GT Logistics’s quotation or GT Logistics otherwise confirms that it will provide the Services.

2.4 GT Logistics’s liability shall be governed by these T&Cs and to the exclusion of any other conditions, unless otherwise agreed in writing.


3. Services

3.1 GT Logistics agrees to perform the Services as set out in the service order or quotation, which may include pickup, warehousing, transport, customs clearance, delivery and any other ancillary services.

3.2 The Customer shall supply GT Logistics with all information required for the performance of the Services (e.g., dimensions, weight, nature of goods, dangerous goods status, delivery address, customs details).

3.3 The Customer shall ensure that the Shipment is properly and safely packed, labeled and ready for transport and that all legal, regulatory and customs requirements are fulfilled.


4. Customer Obligations

4.1 The Customer warrants that they are either the owner of the Shipment or duly authorized by the owner to enter into this Agreement.

4.2 The Customer shall pay all charges due (including any additional costs) within the terms agreed, and provide any required documentation in a timely manner.

4.3 The Customer shall inform GT Logistics in writing of any special instructions or handling requirements. GT Logistics may refuse to comply with instructions which it considers unsafe or unlawful.

4.4 The Customer shall indemnify GT Logistics for any loss, damage, liability, costs or expenses arising out of incorrect or incomplete information provided by the Customer or failure to fulfil these obligations.


5. GT Logistics’s Obligations & Liability

5.1 GT Logistics shall perform the Services with reasonable care and skill and in accordance with applicable laws and regulations.

5.2 Except as expressly stated in these T&Cs, GT Logistics gives no warranty as to transit times or delivery by any particular date.

5.3 GT Logistics’s liability for loss of or damage to a Shipment, or delay in delivery, shall be limited as set out in Section 6.

5.4 GT Logistics shall not be liable for any indirect, special or consequential losses (including, without limitation, loss of profits, business opportunity, reputation or goodwill) howsoever arising.


6. Limitation of Liability

6.1 Unless otherwise agreed, GT Logistics’s liability (howsoever arising) is limited to the lesser of:

  • the Invoice Value of the Shipment (or declared value if greater and accepted by GT Logistics), or
  • an amount equal to the charges paid for the relevant Service. 6.2 GT Logistics is not liable for loss or damage caused by:
  • Force Majeure (including but not limited to acts of God, war, riots, civil commotion, strikes, lockdowns, accident, fire, earthquake, flood)
  • Acts or omissions of the Customer or other third‑party carriers beyond GT Logistics’s control
  • Improper or inadequate packing by the Customer
  • Hidden or latent defects in the goods 6.3 The time limits for claims:
  • For apparent damage: notice must be given in writing immediately upon delivery (or expected delivery)
  • For non‑apparent damage: notice must be given in writing within [ X ] days from delivery
  • All actions in respect of the Services shall be time‑barred one year from the date of delivery or the date when delivery should have taken place.

7. Charges, Payment & Additional Costs

7.1 The Customer shall pay GT Logistics’s charges as set out in the quotation or service order, plus any additional costs incurred (e.g., customs duties, storage fees, demurrage, duties for oversized goods, special handling).

7.2 Unless otherwise agreed, payment is due [within 30 days / on receipt / other term] of GT Logistics’s invoice.

7.3 If payment is not made by the due date, GT Logistics may suspend or cancel further services without liability, and may charge interest, recovery costs and hold the goods under a lien until payment is made.

7.4 The Customer is responsible for any taxes, duties or levies imposed by authorities in relation to the Services.


8. Insurance & Refundable Insurance Payment

8.1 The Customer may request insurance cover for the Shipment, arranged either through GT Logistics or by the Customer’s own insurers, covering loss or damage during transit or storage under the Services.

8.2 If the Customer elects an insurance option provided by GT Logistics, the Customer shall pay the Insurance Payment at the time of Service order.

8.3 Refund Policy: Provided that delivery to the consignee is successful, and no claim is made under the insurance cover, the Insurance Payment shall be refunded to the Customer within 3 business days after proof of Delivery is accepted by GT Logistics and no outstanding liabilities remain.

8.4 In the event of loss or damage to the Shipment and an accepted insurance claim paid out, the Insurance Payment will not be refunded and will instead be applied according to the terms of the insurance policy.

8.5 The Customer must notify GT Logistics in writing of any potential claim under the insurance cover within [3 days of delivery or discovery of damage/loss, and must cooperate fully in any investigation.


9. Pickup & Delivery

9.1 The Customer shall provide accurate pickup and delivery addresses, contact details, and any access instructions or restrictions.

9.2 GT Logistics will attempt delivery at the agreed time and place, but times are estimates only unless a guaranteed delivery service has been explicitly agreed.

9.3 If the consignee is not available to accept delivery, or the delivery address is inaccessible, GT Logistics may return the Shipment to the Customer or store it subject to storage fees and/or redelivery charges.

9.4 Title to and risk in the goods shall pass to the Customer (or consignee) upon delivery, unless otherwise agreed in writing.


10. Force Majeure

10.1 GT Logistics shall not be liable or deemed to be in breach of the Agreement for any failure or delay in performing the Services caused by or attributable to Force Majeure events (including – but not limited to – acts of God, war, civil unrest, terrorism, pandemics, industrial disputes, governmental actions, natural disasters, transport network breakdowns, fire, strike, flood).

10.2 In the event of Force Majeure, GT Logistics may, at its option, suspend performance of the Services or terminate the Agreement without liability. The Customer shall reimburse GT Logistics for any costs we may incur up to the date of suspension or termination.


11. Confidentiality & Data Protection

11.1 Both parties shall keep confidential any information disclosed by the other party which is marked as confidential or which should reasonably be considered confidential.

11.2 GT Logistics may collect, store and process data about the Customer and the Shipment for the purposes of providing the Services, billing and legal compliance. GT Logistics will treat such data in accordance with applicable data protection and privacy laws.


12. Governing Law & Jurisdiction

12.1 The Agreement shall be governed by and construed in accordance with the laws of California, unless otherwise agreed in writing.

12.2 The Customer and GT Logistics submit to the exclusive jurisdiction of the courts of [California for any dispute arising under or in connection with the Agreement.


13. General Provisions

13.1 If any provision of these T&Cs is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.2 No waiver by GT Logistics of any breach of these T&Cs shall be deemed a waiver of any subsequent breach.

13.3 These T&Cs may be amended by GT Logistics from time to time. The version posted on the GT Logistics website shall prevail. The Customer is responsible for reviewing the T&Cs periodically.

13.4 Nothing in these T&Cs shall confer any rights on any third party unless expressly stated.

13.5 The headings in these T&Cs are for convenience only and do not affect interpretation.
